1. Scope

These Terms and Conditions ("Terms") govern all purchases made through the online shop at www.nanoeyewear.com (the "Site"). By placing an order, you accept these Terms in the version in force at the time of your order. Deviating terms of the customer do not apply unless we have expressly agreed to them in writing.

2. Seller

The Site is operated by Nano Eyewear, Switzerland. Contact: office@nanoeyewear.com.

3. Products

Our frames are made from handmade acetate. Small variations in colour, texture and finish are a natural result of this process and are not considered defects. Product images are as accurate as possible, but colours may appear differently depending on your screen.

We produce in small runs. All offers are subject to availability.

4. Orders and conclusion of contract

The presentation of products on the Site does not constitute a binding offer. By completing checkout, you submit a binding offer to purchase the selected products. The contract is concluded when we confirm your order by email.

We may decline an order, in particular if a product is no longer available or if the order contains an obvious error in price or product information. In this case, any payment already made will be refunded in full.

Orders can only be changed or cancelled before dispatch and only with our confirmation by email.

5. Prices and payment

All prices are stated in Swiss francs (CHF) and include Swiss value added tax (VAT). Shipping costs, if any, are shown at checkout before you place your order.

Payment is due at the time of order and is processed by our payment provider using the methods offered at checkout. We do not store your full payment details. Ownership of the products passes to you upon full payment.

6. Delivery

We deliver to the address provided in your order. Delivery times are stated on our Shipping & Returns page and are estimates, not guaranteed dates. Risk of loss or damage passes to you upon delivery.

For deliveries outside Switzerland, import duties, taxes and customs fees may apply and are borne by the recipient.

7. No returns or exchanges

Swiss law does not provide a statutory right of withdrawal for online purchases. We do not currently accept returns or exchanges, and all sales are final. Your rights in the event of a defect under section 8 remain unaffected.

8. Inspection and warranty

Please inspect your order upon receipt. Damaged, defective or incorrect items must be reported to us within 7 days of delivery, with your order number and photos. Defects that only become apparent later must be reported immediately after discovery.

We warrant that our products are free from material and manufacturing defects for two (2) years from delivery. In the event of a justified claim, we will, at our choice, repair or replace the product. If repair or replacement is not possible, we will refund the purchase price.

The warranty does not cover normal wear and tear, scratches on lenses, damage caused by accidents, improper use or care, or modifications made by third parties.

9. Liability

We are liable for damage caused intentionally or through gross negligence. To the extent permitted by law, any further liability, including for indirect or consequential damage and loss of profit, is excluded. Mandatory statutory liability, in particular under the Swiss Product Liability Act, remains unaffected.

10. Intellectual property

All content on the Site, including texts, images, logos, product designs and the name "Nano Eyewear", is our property or used with permission. Any use without our prior written consent is prohibited.

11. Data protection

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). Details are set out in our Privacy Policy.

12. Changes to these Terms

We may amend these Terms at any time. The version published on the Site at the time of your order applies to that order.

13. Severability

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is not affected. The invalid provision shall be replaced by a valid provision that comes closest to its economic purpose.

14. Governing law and jurisdiction

The place of jurisdiction is the seat or domicile of the seller in Switzerland. Consumers may also bring proceedings at the courts of their place of residence; mandatory consumer jurisdiction rules remain reserved.
